Welcome to MILLER & MOTION. These Terms and Conditions outline the rules, policies, and procedures governing the use of our website, our services, and any agreements made between MILLER & MOTION and our clients.
By accessing this website or commissioning our services, you agree to comply with and be bound by the following Terms and Conditions.
If you do not agree with any part of these terms, please do not use our website or services.
1. Terminology
The following terminology applies to these Terms and Conditions, the Privacy Statement, and all Agreements:
“Client,” “You,” “Your” – refers to you, the person or entity accessing this website or engaging our services.
“The Company,” “We,” “Us,” “Our” – refers to MILLER & MOTION.
“Parties” – refers collectively to both the Client and MILLER & MOTION.
2. Cookies
We use cookies to enhance user experience. By accessing MILLER & MOTION, you agree to our use of cookies in accordance with our Privacy Policy.
3. Intellectual Property & License
Unless otherwise stated, MILLER & MOTION and/or its licensors own the intellectual property rights for all material on this website and for all commissioned works.
All rights are reserved unless explicitly transferred in writing.
You may not:
Republish, sell, rent, or sub-license material from MILLER & MOTION
Reproduce, duplicate, or redistribute content from MILLER & MOTION without written permission
Usage rights for commissioned work are granted as specified in your individual project agreement (see Section 11).
4. Hyperlinking to Our Content
The following organizations may link to our website without prior written approval:
Government agencies
Search engines
News organizations
Online directory distributors in the same manner as other listed businesses
Accredited businesses, excluding soliciting non-profit organizations and charity fundraising groups
Links must:
Not be deceptive
Not falsely imply sponsorship or endorsement
Fit within the context of the linking site
We reserve the right to request removal of any link at any time.
5. General Project Conditions
All project costs exclude statutory travel expenses.
Additional costs (e.g., actors, locations, props) will be agreed upon in advance.
6. Payment Terms
50% deposit upon order confirmation
50% upon delivery
Payment term: 10 working days
7. Cancellation Policy
If a client cancels after signing a contract, the following cancellation fees apply:
Cancellation Time Before Production
Up to 8 weeks – 50%
Up to 4 weeks – 75%
Up to 1 week – 90%
Less than 1 week / day of production – 100%
Force majeure cancellations are exempt from fees.
8. Package Models
Minimum term: 3 months, unless otherwise agreed
Termination possible monthly with 14 days’ notice after the minimum term ends
9. Strategy & Consulting Projects
Applies to projects such as content strategy, creative direction, or text work.
The client is responsible for implementing the strategy.
Feedback must be provided within 5 working days.
Texts and strategies may not be shared with external providers or marketed under the client’s name without written consent.
10. Delivery Deadlines
For cinematic projects:
First version of cinematic cuts: within 10 working days after the last shooting day
First version of reels: within 15 working days after the last shooting day
For strategy deliverables:
Editorial plan: within 5 working days after the start of the month
Text packages: within 5–7 working days after briefing
Feedback rounds are processed within the following working week
11. Approval Process
Clients receive a preview version after each production phase.
Approval must be given in writing within 10 working days.
If no response is received, the work is deemed approved.
12. Working Hours
Standard working hours are up to 9 hours per day.
Any additional hours started will be charged separately.
13. Data Storage
After project completion, data will be stored on our servers for 12 months.
Storage may be extended for two additional years at a cost of €650.
14. Data Protection & Copyright
The client ensures that all featured individuals consent to publication.
MILLER & MOTION may assist with obtaining releases.
The client is responsible for all necessary trademark or filming permissions.
All usage rights for commercial purposes (online, social media, events) are included in the offer.
Copyright remains with MILLER & MOTION.
MILLER & MOTION may use the project for reference purposes (website, showreel, social media).
15. Revision Policy
One revision round is included (no fundamental structural changes).
Each additional revision: €150/hour.
For strategic projects: two feedback rounds per month are included; further revisions also €150/hour.
16. Performance Disclaimer
MILLER & MOTION does not guarantee reach, engagement, or commercial success of published content, as these depend on platform algorithms and external factors beyond our control.
17. Limitation of Liability
To the maximum extent permitted by law, MILLER & MOTION excludes all representations, warranties, and conditions relating to this website and its services.
Nothing in this disclaimer will:
Limit liability for death or personal injury
Limit liability for fraud or fraudulent misrepresentation
Exclude any liability not permitted under applicable law
As long as the website and related services are provided free of charge, MILLER & MOTION is not liable for any loss or damage of any nature.
18. Reservation of Rights
We reserve the right to update these Terms and Conditions and our policies at any time.
Continued use of our website or services constitutes acceptance of these changes.
